Asia Briefing Releases New Guide: Human Resources and Payroll in China

China's Transfer Pricing Obligations

The transfer pricing regime in China is generally consistent with the OECD guidelines and has developed rapidly over the past few years. A number of factors brought transfer pricing issues to the forefront of the State Administration of Taxation's attention, including the tendency for FIEs in China to declare operating losses and to rely on intellectual property and services provided by overseas related parties, as well as the introduction of tough transfer pricing regimes by key trading partners. The 2008 tax changes increased the incentive to use transfer pricing to influence effective tax rates, and in 2009, the SAT released the Transfer Pricing Regulations.

China Profit Repatriation Techniques

The George W. Bush-sanctioned U.S. dividends tax cuts are likely to come to an end early in 2013 under current U.S. President Barack Obama's second term. This may result in U.S. dividends tax being raised from the current level of 15 percent to somewhere in the region of 40 percent. Accordingly, there is some urgency in getting dividends realized in overseas subsidiaries, such as those in China, back to the United States before the U.S. domestic dividends tax ceiling is raised.

   

Letters from America: Chinese Students' Economic Contributions to the United States

A lesser known part of the U.S.-China (and U.S.-Asia) relationship is the huge amount of income many American states now generate through the sale of education to students from Asia. Close to US$5 billion was generated last year through the enrollment of students from China alone at American colleges and universities. When you take all international students from Asia into account, that number jumps to roughly US$13 billion.

Regulations Released on VAT Deduction Certificates for General Taxpayers in Guangdong Province

Guangdong's Provincial Office of the State Administration of Taxation released a regulation concerning the VAT deduction certificates of VAT general taxpayers in the province on November 14, clarifying deduction conditions and periods for five types of deduction certificates. India Set to Release GAAR Final Draft

The Indian government is likely to announce the final draft of the General Anti-Avoidance Rules (GAAR) within the next 10 days, according to the country's Finance Minister P. Chidambaram. "A decision has been taken on GAAR," Chidambaram said. "The draft has been sent to the Prime Minister. Hopefully, the decision will be made public in the next 7-10 days."

U.S. President Obama Addresses Pressing Issues at East Asia Summit

Recently reelected U.S. President Barack Obama met this week with some of Asia's top leaders at the 7th East Asia Summit in Phnom Penh, Cambodia, as part of a broader regional tour. The president used the opportunity to promote American economic interests and tackle vital regional issues.

Spectrum winners will have to pay by December 1 (HBL)
Winners of recently held 2G spectrum auction will have to make payment, either in full or at least 33 per cent of the due amount, by December 1, the Department of Telecom (DoT) said today.
BSNL cuts 2012-13 revenue target by over Rs 2,500 cr (HBL)
