Adult Drug Court

Judge says potential Columbia County treatment court should focus on tough cases – Columbia County, WI

If Columbia County inaugurates a treatment court, it should focus on high-risk addicts of alcohol or other drugs — people whose criminality stems mainly or entirely from their dependence on substances.



Program marks 10 years of changing addicts' lives – Henrico County, VA

For a while, Wilbert Harris was a functioning addict. He served in the military for 12 years. When he came home, he had a variety of odd jobs, mostly in construction. But his affinity for alcohol, cocaine and heroin eventually landed him in jail.



Racing for recovery and a cure – Frederick County, MD

Shorb started using drugs as an adolescent, graduating from pot to crack and then, finally heroin. He's been clean since 2008, the year he graduated from Frederick County Drug Treatment Court. Shorb now works full time at Mountain Manor in Emmitsburg, helping people whose shoes he used to fill. He's working toward a degree at Hagerstown Community College in social work and plans to specialize in addictions.

“I tell them that up front, ‘If you want the easy way out, if you’re not committed, if you’re not ready for it, we’ll give you something else,’ said Melissa Stango, the public defender who represents the vast majority of the veterans. “Surprisingly most of them choose to stay.”



Veterans Treatment Court holds graduation today – Hamilton County, Kentucky


Six U.S. military veterans graduate from Hamilton County Municipal Court Veterans Treatment Program today. Judge Melissa Powers created the program in 2010 to help veterans who are criminal defendants cope with trauma resulting from warfare. The goal is to provide them with services and support to help them heal and get a second chance.

Obama Lied to Public About Whether Government Was Listening to Our Calls

Well, here again is further proof that all that hopey, changey, malarkey was nothing more than ... malarkey.

Via the Washington Post yesterday:

The Obama administration secretly won permission from a surveillance court in 2011 to reverse restrictions on the National Security Agency's use of intercepted phone calls and e-mails, permitting the agency to search deliberately for Americans' communications in its massive databases, according to interviews with government officials and recently declassified material.

In addition, the court extended the length of time that the NSA is allowed to retain intercepted U.S. communications from five years to six years -- and more under special circumstances, according to the documents, which include a recently released 2011 opinion by U.S. District Judge John D. Bates, then chief judge of the Foreign Intelligence Surveillance Court.

What had not been previously acknowledged is that the court in 2008 imposed an explicit ban -- at the government's request -- on those kinds of searches, that officials in 2011 got the court to lift the bar and that the search authority has been used.

There IS life out there. People doing other things who do not spend every moment of the day and night studying what is happening in our beloved country, i.e. it's fundamental change as is being manifested moment by moment by a rogue government! (See the flash of her teeth in snarl.) For this moment, a change-up to parallel realities. ENJOY!

This first adventure is older but the "Hank" story below reminded me of a trip I followed six years ago by someone who called himself Grandpa. His wonderful bike journey at the ripe young age of 59, from Florence, Oregon, to Yorktown, Virginia is still out there on the internet at Grandpa Lost His Mind. It is timeless, full of humor, people, pictures, American stories.

This bike is called a recumbent or "bent" for short. It is very comfortable, as you ride in a reclined position. I call this bike "Ol' Blue." I am proud to say, everything from the Rans Stratus bike, to the Zzipper wind screen, to the Burley trailer are top quality American Made products! olblue5.jpg

For twenty years I have dreamed about riding my bicycle across America. It wasn't practical because I could not possibly get away from my job for three months and expect my job to be there when I returned! I wanted to retire early enough that I would still have the strength to fulfill my dream. I am now retired and even though I am physically capable to make this journey, I have had my sanity brought into question. I am very thankful to my dear wife for her eventual support.

Q. Why are you doing this Grandpa?
A. Because I don't want to regret NOT DOING the things I have always dreamed about.

Q. No, really! Why?
A. Okay. It all began when my wife hatched a surefire plan to get rid of me. Knowing I needed to shape up a bit, she suggested I buy a bike and go for a ride ... to a different coast! Now I've been married long enough to know that those sweet words might never come around again ... so I'm outta here!.

Q. I bet you're doing this for your health. Right?
A. I am doing it as a physical and mental challenge to myself and it will be an exercise of dicipline and determination.

Q. Will you miss your wife?
A. Most certainly.

Q. Will your wife miss you?
A. Like a hole in the head!

Q. Are you going through a midlife crisis?
A. I only wish 59 was midlife!

I sent Grandpa an e-mail (located on his site) telling him about this post and asking if there was one day in particular he thought would be interesting to include. His reply:

I can't think of any particular day to highlight ... there were so many ordinary days that turned to amazing days, not by the journey but by the wonderful people I met on the backroads of America. Off hand I think about the young man who came out of nowhere and fixed a flat for me when I had no more patches ... the lovely Hattie Stinett, ... the young girl, Rachel, who returned my lost wallet with $800 cash in it, ... Karl and Sima Shapiro, the old Jewish man who, along with his mom and dad, were the only survivors from a town of 5,000 Jews during the holocaust, ... or Bob the Baptist preacher and his wife Violet who prepared full, old fashioned meals for cyclists who came through their little town, ... or 86 year old June Curry, the Cookie Lady who for over 30 years maintained a hostel for bicyclists who traveled through her little town, ...or the lady in Virginia who, after reading my journal that night, drove fifty miles the next day to find me and asked me to write a children's book about my journey, ... or Jesse Whitecrow who was walking across America, ... or the Methodist preacher in Virginia who was wearing nothing but flip flops and spandex shorts while smoking a cigarette and drinking a beer and invited me to sleep in his sanctuary that night, ... or the countless people who didn't know me but would stop me and ask if I needed water or a snack. I could go on and on but you get my point. In my 65 years, that two and a half month trip did more to define just who America is than any other time in my life.

AUDIENCE: Consumer, Eye Care, Pharmacy, Patient, Health Professional

ISSUE:  Altaire Pharmaceuticals, Inc., announced that it is voluntarily recalling a total of nine (9) lots of Carboxymethylcellulose Sodium 0.5% Ophthalmic Solution, 30 mL, to the consumer level. Due to complaints of mold found in the 30 mL bottles after use, concerns regarding the effectiveness of the preservative after use and handling of the product by consumers have prompted the recall.

A product whose preservative may not be effective could lead to the use of a contaminated product which creates a potential risk for eye infection.

BACKGROUND: Carboxymethylcellulose Sodium 0.5% Ophthalmic Solution is a non-prescription (OTC) drug product used to relieve dryness of the eye and packaged in a plastic bottle inside a unit box.

The product is labeled as follows (refer the Firm Press Release for a detailed product list containing affected lot numbers):

  • equate Restore Tears Lubricant Eye Drops Carboxymethylcellulose Sodium 0.5%, Sterile, 1 FL OZ (30 mL) - Distributed by Wal-Mart Stores, Inc.
  • Lubricant EYE DROPS FOR MILD TO MODERATE DRY EYE, STERILE, 1 FL OZ (30 mL), for Mild to Moderate Dry Eye - Distributed by CVS Pharmacy, Inc.
  • lubricant eye drops for mild to moderate dry eye, STERILE, 1 FL OZ (30 mL) - Dist. by Target Corp.


RECOMMENDATION: Consumers who have the product with any of the lot numbers listed in the Firm Press Release should stop use of the product immediately and return it to the place of purchase.

Consumers with questions regarding this recall can contact Altaire Pharmaceuticals at 1-800-258-2471, Monday – Friday from 9 am – 5 pm ET. Consumers should contact their physician or healthcare provider if they have experienced any problems that may be related to taking or using this drug product.

ISSUE: McNeil Consumer Healthcare is voluntarily recalling at the retail level three lots, approximately 200,000 bottles, of Concentrated MOTRIN Infants’ Drops Original Berry Flavor 1/2 fl oz bottles distributed in the United States (refer to Firm Press Release for full product list). 

After releasing these three lots of Concentrated MOTRIN Infants’ Drops Original Berry Flavor 1/2 fl oz into the market, tiny plastic particles (approximately 1 mm in size or about the size of a poppy seed) were identified in a different product lot during manufacturing. This lot was not released to the market. It was determined that the particles originated in a shipment from a third party supplier of ibuprofen, the active ingredient in Concentrated MOTRIN Infants’ Drops Original Berry Flavor 1/2 fl oz. Out of an abundance of caution, McNeil is voluntarily recalling the three lots released to the market made with the same batch of active ingredient.

BACKGROUND: Concentrated Infants’ MOTRIN Drops Dye-Free Berry Flavor 1 fl oz is not included in this recall. Children’s or Adult MOTRIN products are not included in this recall.  

RECOMMENDATION:  McNeil is asking retailers to remove the affected lots from store shelves, and is asking consumers to stop using and dispose of any product they may have that is included in this recall.

University Compounding Pharmacy Injection Products: Recall - Lack of Sterility Assurance

AUDIENCE: Consumer, Pharmacy, Patient, Health Professional

ISSUE:  University Compounding Pharmacy is voluntarily recalling products, including Testosterone Cypionate (Sesame Oil), Testosterone Cypionate/Testosterone Proprionate, and PGE-1 NS, for injection, to the consumer level (refer to Recall Notice for a detailed product list with affected lot numbers and expiry dates).  In a recent inspection, FDA investigators observed that methods used by the Independent Third Party laboratory to assess sterility may have resulted in pharmacies receiving inaccurate laboratory test results. FDA has concerns that results obtained from the laboratory are not reliable. If there is microbial contamination in products intended to be sterile, patients are at risk of serious infections which may be life threatening.

BACKGROUND: The prescription preparations were distributed nationwide from May 9th, 2013 to September 7th, 2013.The preparations would have been sold, directly to customers by pick up and by mail. 

RECOMMENDATION:  Customers that have product which is being recalled should stop using it and contact University Compounding Pharmacy to arrange for return of unused product. Customers with questions regarding this recall can contact University Compounding Pharmacy at 1875 Third Ave, San Diego CA 92101 619-683-2005.

Customers should contact their physician or healthcare provider if they have experienced any problems that may be related to taking or using these preparations.

Back to finance. Poland did exactly what I and a few others have been warning about for years with regards to private retirement accounts and pensions. Poland confiscated 50% of all private pension funds last week. PRIVATE pensions.

As Warren Pollock and I have been screaming, one of the largest chunks of collateral left in the system is private retirement money, both in the form of 401(k)s and IRAs and in private pension accounts. In the U.S., the latest data for 2012 shows that there are now $10.5 Trillion in private 401k and IRA holdings, with another $9 Trillion in pensions and annuities.

The regime has been fairly open about its plans to "nationalize", read CONFISCATE, this collateral and implement a system of "mandatory retirement savings accounts", which will be just another confiscatory redistribution into the hands of the oligarchs and their cronies. While the world was glued to the developments in the Mediterranean in the past week, Poland took a page straight out of Rahm Emanuel's playbook and in order to not let a crisis go to waste, announced quietly that it would transfer to the state - i.e., confiscate - the bulk of assets owned by the country's private pension funds (many of them owned by such foreign firms as PIMCO parent Allianz, AXA, Generali, ING and Aviva), without offering any compensation. As Congress debates whether to support President Obama's call for a limited strike against Syria for the alleged use of chemical weapons, Iran is vowing to back Bashar al-Assad's regime to the hilt and threatening to unleash terrorism should the U.S. strike.

Qassem Soleimani, the head of Iran's Quds Forces, Wednesday told the Assembly of Experts -- the body that chooses the supreme leader -- that "[w]e will support Syria to the end."

And in an unprecedented statement, a former Iranian official has warned of mass abductions and brutal killings of American citizens around the world and the rape and killing of one of Obama's daughters should the United States attack Syria.

Alireza Forghani, the former governor of southern Iran's Kish Province, threw down the gauntlet last week. Forghani is an analyst and strategy specialist in the supreme leader's camp and closely aligned with Mehdi Taeb, who heads the regime's Ammar Strategic Base, a radical think thank, and thus speaks with the blessing of the Islamic regime.

"Hopefully Obama will be pigheaded enough to attack Syria, and then we will see the ... loss of U.S. interests [through terrorist attacks]," he threatened. "In just 21 hours [after the attack on Syria], a family member of every U.S. minister [department secretary], U.S. ambassadors, U.S. military commanders around the world will be abducted. Retired Army Major General Robert H. Scales, is a former commandant of the U.S. Army War College, writes in The Washington Post today that Barack Obama's war on Syria is a war that the Pentagon definitely doesn't want (below emphasis - mine):

[...] After personal exchanges with dozens of active and retired soldiers in recent days, I feel confident that what follows represents the overwhelming opinion of serving professionals who have been intimate witnesses to the unfolding events that will lead the United States into its next war.

They are embarrassed to be associated with the amateurism of the Obama administration's attempts to craft a plan that makes strategic sense. None of the White House staff has any experience in war or understands it. So far, at least, this path to war violates every principle of war, including the element of surprise, achieving mass and having a clearly defined and obtainable objective.

They are repelled by the hypocrisy of a media blitz that warns against the return of Hitlerism but privately acknowledges that the motive for risking American lives is our "responsibility to protect" the world's innocents. Prospective U.S. action in Syria is not about threats to American security. The U.S. military's civilian masters privately are proud that they are motivated by guilt over slaughters in Rwanda, Sudan and Kosovo and not by any systemic threat to our country.

They are outraged by the fact that what may happen is an act of war and a willingness to risk American lives to make up for a slip of the tongue about "red lines." These acts would be for retribution and to restore the reputation of a president. Our serving professionals make the point that killing more Syrians won't deter Iranian resolve to confront us. The Iranians have already gotten the message. ...

The Department of Labor today reported that the U.S. economy created 169,000 jobs last month and the unemployment rate fell from 7.4 percent to 7.3 percent.

However, other than the fact that most of the jobs added so far this year have been part-time jobs, the real news is that the civilian labor force participation rate continues to plunge (almost twice as many people left the work force as found new jobs, the only real reason that the employment rate has shown a decline) -- now at a record 90.5 million -- as half a million more dropped out in one month, taking the labor participation rate to 1978 levels:

While the Establishment survey data was ugly due to both the miss and the prior downward revisions in the NFP print, the real action was in the Household survey, where we find that the number of people not in the labor force rose by a whopping 516,000 in one month, which in turn increased the total number of people outside the labor force to a record 90.5 million Americans.

And what is even worse, the Labor Force Participation Rate declined from 63.4% to 63.2%: the is the lowest print since August 1978!

So much for clear, concise, cohesive, objectives on Syria

As President Obama uses the final day of the G-20 summit to try to build support for a U.S. military strike in Syria, the details of that plan continue to change literally by the day -- with one source telling Fox News that military officials have been asked to revise their plans 50 times since the Pentagon first began considering a "limited" action:

While missile-equipped ships are at the ready in the Mediterranean Sea, a senior defense official told Fox News that the possibility of launching military aircraft strikes was one of the range of options presented to Obama.

The official said the choice the president makes will depend on what he wants included in the target list -- and that seems to shift daily. The regularly fluctuating plans could feed into congressional uncertainty as members prepare to consider a draft resolution next week authorizing military action there.

To say that Barack Obama has had, from the very beginning, no clue whatsoever what he actually expects to accomplish or even what he wanted to accomplish with an attack on Syria is an understatement ... yet he continues to push for an attack as he has had the Pentagon change their prepared plans (plans he requested) ... '50' times. Although planning for multiple scenarios and strategies is necessary and normal, what is not normal is lacking a clear, concise, idea on what you want to accomplish and having cohesive objectives is not. But the latter is what we're stuck with because we have a president that thinks and acts only in terms of politics and his own image, and be damned with what happens to the image of the nation before the world stage ... especially in the eyes of our enemies.

1.  Interest Rates Unchanged for the Fourth Quarter of 2013

2.  Form 990 Availability Resumes; IRS Urges Filers Not to Include Social Security Numbers

Following an internal review, the IRS has resumed making the Form 990 series filed by exempt organizations available. Based on the internal review, the IRS determined there is low risk of Social Security numbers (SSNs) being included in recent Form 990 filings.

3.  Summer 2013 Statistics of Income Bulletin Now Available

The summer 2013 issue of the Statistics of Income Bulletin is available on IRS.gov. The summer 2013 issue features data from Form W-2, Wage and Tax Statement, filed with individual income tax returns for tax years 2008 through 2010.

4.  Proper Allocation of Taxpayers' Refunds

Taxpayers may direct their refunds to more than one account at a bank or other financial institution in the United States using Form 8888, Allocation of Refund; however, they may not request deposit of their refunds to accounts that are not in their names, such as their tax preparers' accounts. And per regulations in Circular No. 230, a practitioner who prepares tax returns may not endorse or otherwise negotiate any check issued to a client by the government in respect of a federal tax liability. 5.  Technical Guidance

REG-136630-12 -- Information Reporting by Applicable Large Employers on Health Insurance Coverage Offered Under Employer-Sponsored Plans -- Proposed regulations providing guidance to employers that are subject to the information reporting requirements under section 6056 of the Internal Revenue Code (Code), enacted by the Affordable Care Act. Section 6056 requires those employers to report to the IRS information about their compliance with the employer shared responsibility provisions of section 4980H of the Code and about the health care coverage they have offered employees. Section 6056 also requires those employers to furnish related statements to employees so that employees may use the statements to help determine whether, for each month of the calendar year, they can claim on their tax returns a premium tax credit under section 36B of the Code (premium tax credit). Written or electronic comments must be received by November 8, 2013. Requests to speak and outlines of topics to be discussed at a public hearing scheduled for November 18, 2013, at 10 a.m., must be received by November 8, 2013.

These proposed regulations are scheduled to be published in the Federal Register Sep. 9, 2013.


REG-132455-11 -- Information Reporting of Minimum Essential Coverage – Proposed regulations providing guidance to providers of minimum essential health coverage that are subject to the information reporting requirements of section 6055 of the Internal Revenue Code, enacted by the Affordable Care Act. Health insurance issuers, certain employers and others that provide minimum essential coverage to individuals must report to the IRS information about the type and period of coverage and furnish related statements to covered individuals. These proposed regulations affect health insurance issuers, employers, governments, and other persons that provide minimum essential coverage to individuals. Written or electronic comments must be received by November 8, 2013. Requests to speak and outlines of topics to be discussed at a public hearing scheduled for November 19, 2013, at 10 a.m., must be received by November 8, 2013.

These proposed regulations are scheduled to be published in the Federal Register Sep. 9, 2013.

Notice 2013-56 provides transitional relief from penalties for a section 6050W filer reporting incorrect taxpayer identification number (TIN) information on information returns (Form 1099-K) and payee statements filed under section 6050W of the Internal Revenue Code.

Notice 2013-56 will be published in Internal Revenue Bulletin 2013-39 on Sept. 23, 2013.

FDA Explores Impact of Arsenic in Rice

The Food and Drug Administration (FDA) has taken a major step towards learning whether levels of arsenic in rice and rice products pose a risk to public health. The agency has collected a total of more than 1,300 samples of rice and rice products and has tested them for both total arsenic and inorganic arsenic, the more toxic form.
FDA scientists have determined that the levels of inorganic arsenic found in the samples are too low to cause immediate health damage. The next step is a comprehensive assessment of the public health risk.
