FTC Halts Two Automobile Dealers' Deceptive Ads

Two car dealers from Maryland and Ohio have agreed to settle the Federal Trade Commission’s charges that they falsely advertised the cost or available discounts for their vehicles. The settlements, part of the FTC’s continuing crackdown on deceptive motor vehicle dealer practices, prohibit the dealers from advertising discounts or prices unless the ads clearly disclose any qualifications or restrictions.

The FTC charged that Timonium Chrysler, Inc., of Cockeysville, Md., violated the FTC Act by advertising discounts and prices that were not available to a typical consumer. Ganley Ford West, Inc., in Cleveland, also is charged with misrepresenting that vehicles were available at a specific dealer discount, when in fact the discounts only applied to specific, and more expensive, models of the advertised vehicles.

“Buying a car is a huge financial commitment, and people often calculate what they can pay down to the penny,” said Jessica Rich, Director of the FTC’s Bureau of Consumer Protection. “They should be able to depend on the dealers to provide truthful information, and they can depend on the FTC to enforce consumer protection laws on the lot.”

Timonium Chrysler’s website touted specific “dealer discounts” and “internet prices,” but allegedly failed to disclose adequately that consumers would need to qualify for a series of smaller rebates not generally available to them. The complaint further alleges that, in many instances, even if a consumer qualified for all the rebates, the cost of the vehicle was still greater than the advertised price.

Ganley Ford advertised its discounted vehicles on its website and in local newspapers, and it allegedly failed to disclose that its advertised discounts generally only applied to more expensive versions of the vehicles advertised.

The proposed orders settling the FTC's charges against Timonium Chrysler and Ganley Ford are designed to prevent them from engaging in similar deceptive advertising practices in the future. The two auto dealers cannot advertise prices or discounts unless accompanied by clear disclosures of any required qualifications or restrictions. The auto dealers are also barred from misrepresenting:

  • the existence or amount of any discount, rebate, bonus, incentive, or price;
  • the existence, price, value, coverage, or features of any product or service associated with the motor vehicle purchase;
  • the number of vehicles available at particular prices; or
  • any other material fact about the price, sale, financing, or leasing of motor vehicles.

The dealers must maintain and make available copies of all advertisements and promotional materials to the Commission for inspection upon request for the next five years, and they are required to comply with the FTC’s order for 20 years.

Consumers in the market for a new or used vehicle should read the FTC’s car ads and buying and owning a car.

The Commission vote to issue the administrative complaints and accept the consent agreement packages containing the proposed consent orders for public comment was 4-0. The agreement will be subject to public comment for 30 days, beginning today and continuing through October 3, 2013, after which the Commission will decide whether to make the proposed consent order final. Interested parties can submit written comments electronically for Timonium Chrysler and Ganley Ford or in paper form.

Comments submitted in paper form should be mailed or delivered to: Federal Trade Commission, Office of the Secretary, Room H-113 (Annex D), 600 Pennsylvania Avenue, N.W., Washington, D.C., 20580. The FTC is requesting that any comment filed in paper form near the end of the public comment period be sent by courier or overnight service, if possible, because U.S. postal mail in the Washington area and at the Commission is subject to delay due to heightened security precautions. 

NOTE: The Commission issues an administrative complaint when it has “reason to believe” that the law has been or is being violated, and it appears to the Commission that a proceeding is in the public interest. When the Commission issues a consent order on a final basis, it carries the force of law with respect to future actions. Each violation of such an order may result in a civil penalty of up to $16,000.

Summer 2013 Statistics of Income Bulletin Now Available

WASHINGTON — The Internal Revenue Service today announced that the summer 2013 issue of the Statistics of Income Bulletin is available at IRS.gov. The summer 2013 issue features data from Form W-2, Wage and Tax Statement, filed with individual income tax returns for tax years 2008 through 2010. 

The Statistics of Income (SOI) Division produces the SOI Bulletin on a quarterly basis. Articles included in the publication provide the most recent data available from various tax and information returns filed by U.S. taxpayers. This issue of the SOI Bulletin also includes articles on the following topics:

  • Wage Income and Elective Retirement Contributions from Form W-2, 2008-2010. The average individual W-2 earnings rose slightly from $40,532 in 2008 to $40,892 in 2010. Some 65.8 million taxpayers with W-2 income participated in an employer-sponsored retirement savings plan in tax year 2010, making $209.2 billion in direct contributions for the year.
  • Sole Proprietorship Returns, 2011. Approximately 23.4 million individual income tax returns reported nonfarm sole proprietorship activity for tax year 2011. Profits rose to $282.6 billion for the year, a 5.6-percent increase from 2010. Total receipts increased to $1.3 trillion for 2011, up 5.9 percent from 2010.  
  • Foreign Recipients of U.S. Income, 2010. Foreign persons received $557.8 billion in U.S.-source income in Calendar Year 2010, representing a 2.1-percent increase over the amount paid in 2009. Interest payments accounted for the largest share of income paid to foreign recipients (46.8 percent) in 2010, followed by dividends (20 percent).
  • Foreign-Controlled Domestic Corporations, 2010. Foreign-controlled domestic corporations (73,210) accounted for 1.3 percent of all U.S. corporation income tax returns filed for tax year 2010. Total receipts for these corporations ($4.1 trillion) and total assets ($11.2 trillion) accounted for 15.5 percent of the receipts and 14.1 percent of the assets reported on all U.S. corporation income tax returns for the year. 
  • Corporate Foreign Tax Credit, 2009. For tax year 2009, some 5,706 U.S. corporations claimed a foreign tax credit of more than $93 billion against their U.S. income tax liability.
  • Unrelated Business Income Tax Returns, 2009. Some 42,469 tax-exempt organizations reported $9.7 billion in gross unrelated business income for tax year 2009.
  • Use of the Empowerment Zone and Renewal Community Employment Credit, Tax Years 1998-2010. Federal empowerment zones (EZ) and renewal communities (RC) are economically distressed geographic areas eligible for temporary tax incentives to encourage economic development. The amount of allowable EZ/RC employment credit claimed on individual and corporate tax returns increased from $41.7 million in 1998, to $277.1 million in 2005, before declining to $172.9 million in 2010.

I owe it to two of my brothers and two of my sisters, and their spouses, who have between them six children in the military, to try to spread the below post as far and wide as possible. I owe it to every family in America that has loved ones in the military.

We have days, if not hours, before Hussein Obama intends to throw America into a war where we will side with terrorists who attacked our country twelve years ago. The atrocities they commit every single day are horrific.

So many of our military went to war to fight these animals - now they are being asked to support them? What kind of sick, demented, leader would ask that of those men and women or ask the American public to support it?

If America partners with Al Qaeda - we are damning ourselves to hell forever. Please read, please forward, PLEASE do what you can!!!

According to Wikipedia, Jabhat al-Nusra intends "to create a Pan-Islamic state under sharia law and aims to reinstate the Islamic Caliphate." As you will see below, many members of the U.S. military understand this, and they absolutely do not want to fight on the side of al-Qaeda.

Not that we should be supporting Assad either. Assad is horrible. He should be rotting in prison somewhere. But just because a country has a bad leader does not mean that we have justification to attack them.

The U.S. military should only be put into action when there is a compelling national interest at stake. And getting involved in a bloody civil war between Assad and al-Qaeda does not qualify.

There was a huge WTF? moment this weekend as I was reading this story on The Blaze. Apparently we're now teaching children that "The Government Is Your Family":
Fourth-grade students in Illinois are learning that "government is like a nation's family" because it sets rules and takes care of needs such as health care and education.

That is the big question as we think of the people's disapproval of Obamacare and the arm twisting that went into getting that monstrosity done, and the FACT that if Hussein Obama thinks he can get away with it, no matter what the people say, no matter how the traitorous congress votes - he will do what he damn well pleases to move his fundamentally changing America agenda forward if he thinks he can get away with it, and most of the time he can, and does.

Washington Post Slams DOJ School-Choice Lawsuit

Even the Washington Post is condemning the Justice Department̢۪s attack on Louisiana̢۪s school-voucher program. The Post's lead editorial today calls the attack "appalling," and concludes the following: "Louisiana parents are clamoring for the choice afforded by this program; the state is insisting on accountability; poor students are benefiting. The federal government should get out of the way."
Interesting how it is that the Obama administration and most others on the left are all about "choice" when it comes to abortion ... but their enthusiasm for "choice" begins and ends with killing the unborn. They couldn't care less about parents having a choice as to where to put their kids, and most parents, including a majority of blacks, support vouchers because they realize it means their children can choose a better school and receive a better education.

To be clear, opposition to school choice is best understood as a form of monopolistic protectionism. The Obama administration is acting solely in the interest of their union base and their leftist allies, whose opposition is founded in economic self-interest. Under the status quo, that self-interest is naturally and inexorably in conflict with the interests of parents, children, and high-achieving teachers.

As Jeremy Beer, Ph.D., Jeffrey J. Cain, Ph.D., and Ilan Wurman have pointed out in their study on school choice in Texas:

The most significant opposition to school-choice initiatives such as vouchers comes from teacher and school administrator organizations. Opposition to school choice and vouchers also draws on ideology -- particularly the historic Progressive preference for centralized, bureaucratic systems of public control and Progressive fearfulness of religion and unassimilated minorities.
The same applies all over the country ... for liberal progressives (i.e. Eric Holder, Barack Obama, and unions), it's all about power, control, and money ... and they could care less about parents having a choice in where and how to educate their children.

Going back to school is about more than shiny shoes and trendy notebooks. It's also about kids making new friends and adding those friends on social network sites like Facebook, Twitter and Instagram.

More than 60 percent of teens in the United States have at least one social media account, according to the American Academy of Child and Adolescent Psychiatry. And while being online is a good way to keep in touch with friends, it's important for parents to be proactive about Internet safety.

Unfortunately, there are people who can use your child's personal information to steal identities, bully them or begin an inappropriate relationship. Help protect students from online dangers by following these safety tips:

1. Keep your child's profile private so that only family and people you know see photos, important dates and other information.

2. Make sure they're not posting personal details, including phone numbers, home address, and the name of their school or Social Security number.

3. Only allow them to publish photos and videos that don't jeopardize their safety or their integrity.

4. Make sure they choose a strong password that can't be guessed, and that it gets changed every three months.

5. Never allow them to accept friend requests from people they don't know.

6. Keep an open dialogue with your children. Ask them to let you know if they've received private messages from a stranger, or from someone at school who is teasing, harassing or threatening them. Those could be signs of cyber-bullying or even a sexual predator.

Garden-Fresh Foods, Inc. of Milwaukee Wisconsin is recalling A Limited Quantity of Spartan Fresh Selections American Potato Salad In 16 oz. Packages, because it has the potential to be contaminated with Listeria monocytogenes, an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems. Although healthy individuals may suffer only short-term symptoms such as high fever, severe headache, stiffness, nausea, abdominal pain and diarrhea, Listeria infection can cause miscarriages and stillbirths among pregnant women.

Hospira Issues A Voluntary Nationwide Recall Of One Lot Of Aminosyn II 10 percent, Sulfite-Free, Due To Foreign Particulate Matter

Hospira, Inc. announced today it is initiating a voluntary nationwide user-level recall of one lot of Aminosyn II 10 percent, Sulfite-Free, 500mL, NDC 0409-4164-03 Lot 26-138-JT. This action is due to one confirmed customer report where an unknown foreign particle was included in the injection port and in contact with product. The foreign particle was confirmed by Hospira as human hair. To date, Hospira has not received reports of any adverse events associated with this issue for this lot. This recall is being conducted as a precautionary measure.

Premier Foods, LLC of Santa Fe Springs, CA is voluntarily recalling four flavored sauces due to the failure to declare the following allergens on the product labels: milk, soy, and/or wheat. The products were sold at Williams-Sonoma. People who have allergies to milk, soy, and/or wheat run the risk of serious or life-threatening reactions if they consume products containing these ingredients.

This is being done because one bag of the product was found to be contaminated with Salmonella.

Happy Labor Day everyone! We hope you are able to get out and enjoy the day at some of your favorite public lands. This photo is of the Cape Cod National Seashore in Massachusetts. Forty miles of pristine sandy beach, marshes, ponds, and uplands support diverse species. Lighthouses, cultural landscapes, and wild cranberry bogs offer a glimpse of Cape Cod's past and continuing ways of life. Swimming beaches and walking and biking trails beckon today's visitors.
